Terms & Conditions

Plain-English terms behind every engagement: what we owe you, what we need from you, and where the lines are.

Last updated: October 2026. These terms, together with your signed proposal or scope document, form the agreement between you and Capgent (Registered Micro Enterprise, Udyam UDYAM-TN-04-0132718).

1. The engagement

The free 48-hour diagnostic carries no obligation. Paid work — 30-day sprints and growth retainers — follows the scope, timeline, and fees in your proposal. Anything outside that scope is quoted separately before work begins.

2. What we need from you

Timely access to ad accounts, analytics, website backends, and CRM systems, plus accurate business information and feedback inside agreed windows. Timelines move at the speed of inputs: delays on access or approvals shift delivery dates by the same margin.

3. Fees & payment

Fees follow the proposal: sprints are fixed-fee, retainers bill monthly in advance. Ad spend is paid directly by you to the platforms (Google, Meta, and others) unless we agree otherwise in writing — platform spend is never our revenue and never refundable by us. See the Refund Policy for cancellation terms.

4. Intellectual property

On full payment, you own the deliverables built for you: pages, creatives, copy, audiences, and documentation. Your brand assets and data were always yours. Our underlying methods, templates, and tooling remain ours and may be reused across engagements — never your confidential information.

5. Confidentiality

Both sides keep the other's non-public information confidential during the engagement and for two years after. Every engagement is covered by NDA on request, and we never publish your numbers or name without written permission.

6. No guaranteed outcomes

We engineer for revenue and report honestly against it, but no agency can guarantee rankings, ROAS, or revenue figures — platforms, markets, and competitors move. Our liability for any claim is capped at the fees you paid us in the three months before the claim.

7. Term & termination

Either side may end a retainer with 15 days' written notice. Work performed to the end date is billed; account access is handed back and our access revoked within 7 days of termination.

8. Governing law & contact

These terms are governed by the laws of India, with courts at Chennai, Tamil Nadu holding jurisdiction. Questions: manoj.marketinghelp@gmail.com or +91 88707 27145.
